By accessing or using Prenotiamo.com.au ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use our services.

These terms apply to all visitors, users, and others who access or use the Platform, including but not limited to individuals making bookings, creating accounts, or submitting support tickets.

Changes to Terms: We reserve the right to modify these Terms and Conditions at any time without prior notice. Changes become effective immediately upon posting. Your continued use of the Platform after any modifications indicates your acceptance of the new terms.

Use of Services

Prenotiamo provides an online booking platform for services and appointments. You may use our Platform for lawful purposes only and in accordance with these Terms.

You agree NOT to:

  • Use the Platform for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe on the rights of others
  • Transmit any harmful code, viruses, or malware
  • Attempt to gain unauthorized access to any part of the Platform
  • Use automated systems (bots, scrapers) without permission
  • Impersonate any person or entity

We reserve the right to refuse service, terminate accounts, or cancel bookings at our sole discretion if we believe these terms have been violated.

User Accounts

To access certain features, you may be required to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring your account information is accurate and up-to-date
  • Notifying us immediately of any unauthorized access

Account Security: You must not share your password with others or allow others to access your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

Account Termination: We reserve the right to suspend or terminate your account at any time if we suspect fraudulent activity, violation of terms, or for any other reason we deem necessary.

Bookings and Payments

When you make a booking through our Platform, you agree to pay all applicable fees and charges. All prices are displayed in Australian Dollars (AUD) unless otherwise stated.

Payment Terms:

  • Payment is required at the time of booking unless otherwise specified
  • All fees are non-refundable except as stated in our Cancellation Policy
  • Prices may change without notice; you will pay the price shown at booking time
  • You authorize us to charge your provided payment method
  • Failed payments may result in booking cancellation

Booking Confirmation: You will receive a confirmation email once your booking is complete. If you do not receive confirmation within 24 hours, contact support immediately.

No Guarantees: While we strive for accuracy, we do not guarantee the availability of services or time slots shown on the Platform. Bookings are subject to confirmation and availability.

Cancellation and Refund Policy

Cancellations must be made through your account dashboard or by contacting support. Our cancellation policy is as follows:

Less than 12 hours

Processing Time: Approved refunds will be processed within 5-7 business days to the original payment method.

No-Show Policy: Failure to attend a scheduled booking without prior cancellation will result in forfeiture of all fees paid. No refund will be issued.

User Conduct and Content

Users may submit content through support tickets, feedback forms, or other Platform features. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for the purpose of operating and improving our services.

You agree that your content will NOT:

  • Be false, misleading, or deceptive
  • Infringe on any intellectual property rights
  • Contain offensive, abusive, or discriminatory material
  • Include spam, advertising, or promotional material
  • Contain personal information of others without consent
  • Violate any applicable laws or regulations

We reserve the right to remove any content that violates these terms or that we deem inappropriate, without notice or liability.

Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, software, and design, is the property of Prenotiamo or its licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.

Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes only. You may not:

  • Reproduce, distribute, or publicly display any Platform content
  • Modify, adapt, or create derivative works
  • Reverse engineer or attempt to extract source code
  • Use content for commercial purposes without written permission
  • Remove or alter any copyright or proprietary notices

Unauthorized use of our intellectual property may result in legal action and termination of your access to the Platform.

Limitation of Liability and Disclaimers

IMPORTANT LEGAL NOTICE

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do NOT warrant that:

  • The Platform will be uninterrupted, secure, or error-free
  • Results obtained from use will be accurate or reliable
  • Any errors or defects will be corrected
  • The Platform will meet your specific requirements

Limitation of Liability: To the maximum extent permitted by law, Prenotiamo, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Platform
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the Platform
  • Any bugs, viruses, or similar harmful components
  • Any errors or omissions in any content
  • Any loss or damage of any kind incurred as a result of your use of the Platform

Our total liability to you for all claims arising from use of the Platform shall not exceed the amount you paid us in the 12 months prior to the claim, or AUD $100, whichever is greater.

Termination and Suspension

We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms and Conditions
  • Providing false or misleading information
  • Fraudulent or illegal activity
  • Abuse of Platform features or support services
  • At our sole discretion, for any other reason

Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Your Rights: You may terminate your account at any time by contacting support. Termination does not relieve you of obligations incurred prior to termination.

Governing Law and Contact Information

Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of Australia, specifically the state/territory where our business is registered. You agree to submit to the exclusive jurisdiction of the courts located in Australia.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
